Rules of the road for drivers and bicyclists listed in New York State’s Vehicle and Traffic Law (VTL) outline the rights and responsibilities of drivers and bicyclists. These rules must be followed, and those who violate them could be ticketed by local law enforcement. A summary of the top ten rules will help you to understand New York bicycle law.

  1. Vehicle drivers must exercise due care to avoid colliding with any bicyclist.
  2. Vehicle drivers may overtake and pass a bicycle to the left when leaving a safe distance between the vehicle and the bicycle.
  3. When exiting a vehicle, drivers should not open the door on the side of moving traffic until it is reasonably safe to do so, and when they can exit without interfering with the movement of other traffic, including bicycles.
  4. Bike riders have all of the same rights and duties of vehicle drivers with some exceptions.
  5. Bike riders should use a bike lane when available and, if not available, opt for a usable right shoulder to prevent undue interference with the flow of traffic.
  6. Bike riders can ride side-by-side, when space allows, but no more than two abreast.
  7. Bike riders must stop before entering a roadway.
  8. Lights are required one half hour before and after sunset, and New York law calls for all riders to operate a bicycle equipped with a bell.
  9. Children ages 5-14 must wear a helmet.
  10. It is unlawful for riders to wear more than one earphone attached to a device.
